Terms & Conditions

These Terms & Conditions (“Terms”) govern access to Animexa, including https://animexa.ai, the Animexa application, AI generation tools, library, credits, subscriptions, and social publishing. By creating an account, purchasing a plan or credit pack, or using the service, you agree to these Terms, our Privacy Policy, Refund and Cancellation Policy, and Shipping and Delivery Policy.

Animexa is a software-as-a-service (SaaS) product operated from India and offered to customers in India and internationally, except where prohibited by law.

1. The service

Animexa lets you generate videos, animations, images, stories, and related creative assets from prompts and uploads, store them in your library, and optionally publish them to connected social accounts. Features, credit costs, and available networks may change as we improve the product. We do not sell physical goods.

2. Eligibility and accounts

• You must provide accurate information and keep your login secure.
• You are responsible for activity under your account.
• You must be at least 13 to create an account. You must be at least 18 (or the age of majority in your country) to purchase a paid plan or credit pack.
• If you use Animexa on behalf of a company, you confirm you have authority to bind that company to these Terms.
• We may suspend or close accounts that violate these Terms, fail payment, or create risk for other users or the service.

3. International availability and payments

We accept customers and payments from outside India, subject to our payment processor’s supported countries, currencies, and sanctions rules. Supported cards, wallets, and local payment methods are shown at checkout.

• Prices are displayed in the application (typically in INR unless another currency is shown). Your bank or card issuer may convert the charge into your local currency and may add FX or cash-advance fees that we do not control.
• Checkout is processed by Razorpay. We do not store full card numbers.
• Taxes (including GST in India, VAT, sales tax, or similar) may be added where required. You are responsible for taxes that apply to your purchase except those we are legally required to collect.
• You authorize us and our processors to charge the payment method you provide for subscriptions, renewals, and credit packs you confirm.
• We do not offer the service in jurisdictions prohibited by applicable export, sanctions, or anti-money-laundering laws.

4. Credits, plans, and billing

• Generation and publishing consume credits according to the prices shown in the application.
• Subscriptions refill credits on each billing cycle until cancelled. Credit packs add credits that do not expire unless we state otherwise at purchase.
• Credits have no cash value, are not transferable between accounts, and are not redeemable for cash except where required by law. See our Refund and Cancellation Policy.
• Failed, cancelled, or unused generations may still consume credits when compute or third-party APIs were used.
• Paid access is delivered digitally to your account. See our Shipping and Delivery Policy.

5. Your content and generated output

You retain rights in prompts, uploads, and other material you provide (“Input”). Subject to the rights of our licensors and third-party models, we grant you a license to use the media Animexa generates for you (“Output”) for personal or commercial use, as long as you comply with these Terms and applicable law.

You grant us a worldwide license to host, process, transcode, and display Input and Output as needed to operate the service, including generating, storing, showing previews, and posting when you ask us to.

AI output can be inaccurate, similar to other users’ results, or restricted by model providers. You are responsible for reviewing Output before you publish or rely on it.

6. Acceptable use

You agree not to use Animexa to:

• Break the law, infringe IP, privacy, or publicity rights, or generate illegal or exploitative content (including sexual content involving minors).
• Create scams, malware, or content intended to deceive people in a harmful way.
• Harass, threaten, or dox others, or generate non-consensual intimate imagery.
• Attempt to probe, disrupt, or gain unauthorized access to the service, other accounts, or connected platforms.
• Bypass credit limits, watermarks, or safety filters.

7. Social publishing

Optional publishing lets you connect accounts such as Facebook, Instagram, TikTok, or YouTube and schedule posts. You authorize Animexa to post using those connections. You must comply with each platform’s terms. Platforms may reject, delay, label, or remove posts. We are not responsible for platform outages, policy changes, or account bans.

8. Third-party services

The product depends on third parties (authentication, cloud hosting, AI models, payments, and social APIs). Their availability and policies are outside our control.

9. Intellectual property

Animexa, our branding, UI, and software are owned by us or our licensors. These Terms do not transfer ownership of the product to you.

10. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Animexa AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM (OR USD $50 IF YOU PAID NOTHING). Nothing in these Terms limits liability that cannot be limited under the law of your country of residence, including mandatory consumer protections.

12. Indemnity

You will defend and indemnify us against claims arising from your Input, Output, social posts, or violation of these Terms or third-party rights, except to the extent caused by our willful misconduct.

13. Changes and termination

We may change these Terms, the service, or pricing. Continued use after changes take effect constitutes acceptance. You may stop using the service at any time. We may terminate access for violation of these Terms or if we discontinue the product.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India have jurisdiction, except that if you are a consumer in a country that grants you the right to bring claims in your home courts, that right remains. Mandatory consumer laws of your country of residence still apply where they cannot be waived.
